My comment had nothing to do with the Adam Orth incident. This has been a constant rumor that have been circulating for quite some time now by multiple journalists. And of course Microsoft said that, what did you expect them to say? They cannot really talk about the features of a device they haven't announced yet, they cannot confirm nor deny anything.
Also if the Xbox was already designed with a forced always-on type of DMR by the time the rumors starting spreading, it probably would be too late for them to change the design based on customer feedback.
That said, I don't actually believe it will be "always on" Microsoft is not that stupid to realize how many customers this would alienate.
